SAP Welcomes Resolution of Past Compliance Challenges with U.S. and South Africa Authorities

We are pleased that SAP has reached agreements with the U.S. Department of Justice (DOJ), the U.S. Securities & Exchange Commission (SEC) and South Africa’s National Prosecuting Authority (NPA) regarding historic compliance issues, including matters in Indonesia which are relevant under the U.S. Foreign Corrupt Practices Act (FCPA) due to its extra-territorial reach.

SAP fully cooperated with the authorities, and these settlements close all compliance matters under investigation in the United States and South Africa.
The company separated from all responsible people, including in Indonesia, more than five years ago. The past conduct of certain former colleagues and former partners does not reflect SAP’s values or our commitment to ethical behavior.

SAP has made significant enhancements to our compliance program and internal controls over the past few years. Indeed, both the U.S. and South African authorities specifically highlighted SAP’s strong remediation, robust controls, and compliance enhancements.

As stated clearly in our Global Code of Ethics and Business Conduct for Employees (www.sap.com/globalcode), SAP has zero tolerance for non-compliance and remains committed to working with customers and partners to focus our innovation, expertise and resources to help transform businesses and to continue to help drive innovation and prosperity in Indonesia and across all geographies in which SAP operates.
